A Divorce Decree should be specific as to certain components of the benefits being assigned (survivor benefits, definition of Marital Portion, etc.), or the QDRO should be drafted and packaged with the Decree to avoid conflicts.  Either way, our team of experts will make sure that comprehensive and consistent language is used.

Note: Unless the survivorship provisions of benefits assigned under state plans in Ohio is expressed in the divorce decree, there is no way to direct the plan administrator that the assigned benefit contains a survivorship component.
